is it illegal to sell a car without a roadworthy in vic?

im thinking of selling my vs ss but i dont wana part with the number plates and i have no time to get a road worthy as i work 9-5. im thinking of just cancelling the reg and taking the plates off and selling it for 5 or 6k

i heard its illegal to sell a car without a road worthy if its got reg, ive never sold a car b4 n dunno how to do about it. if i get standard plates from vic roads can i sell it with reg and no road worthy? or is it compulsery to get a rwc?

but cant vic roads make u liable if something ****s up or say they dont transfer it in there name and they get fines n **** cant they use it against u

you can sell your car without reg or roady or with reg and no roady, just go and get standard issue plates and sell it like that if you want to keep your plates, you can stool sell it without a roady, but it will prob be more harder to sell it all depends on the buyer, hope that helps

You can even transfur a car without a rwc, rego is suspended after two months if a rwc is not recieved by vic roads. In the past when i have recieved fines for cars that i have sold and have remained in my name I have nominated the new owner as the driver and sent a photocopy of the transfur form along with the nomination statment, havn't have one rejected as of yet.

ive done it many times but im pretty sure by law, a car cant be sold with reg without a roady

Im sure too that its not to be sold without a RWC if it has rego. Lots of people do it though.

With your plates, just go to vicroads and get standard plates issued before you sell it.

well when you sell it, u will have to get transfer papers, write your details and buyers details once that is done give vic roads your transfer papers. the buyer has i think 14 days to transfer it under his name and i think 30 days to get a roadworthy,

if then you by chance get a fine, just tell vic roads the situation by then im sure that they would know if the car has been transferred or not, if not the buyer would recieve the fine not you

yeah can only sell a car with a rwc or de-reg it. just get the bloke who buys it to get his own roady and phone you through the details then fill out your disposal form and hand it in. just make sure he fills out his part of the disposal form so you have his details if he runs a red, ect

what i would recomend is that you sell the car but keep one plate. tell the new owner to organise change of ownership / r/w and get a signed reciept with the date the car changed hands.

tell him that once he has a roady and a change of ownership form filled out he can have the second plate back. give the new owner a timeline and tell him you will report the plates stolen if he doesn't contact you with a r/w or a good excuse before the deadline.

thats what we do at my work when we sell cars as is without r/w

that's ridiculous, you'd actually be making a false dec re one plate being "stolen" and that is illegal

its the law russ. every time a car is registered it must have a roady.

whenever a car changes hands it is considered to be being re-registered hence you need a roady.

they don't care who organises the roady but as above if the car isn't sold with a roady, it can't be driven.

technically speaking once the car is purchased it is no longer the property of the previous owner. between the time that the car has changed hands and is officially recorded as such by vicroads it is unregistered.

the car belongs to one person while the rego belongs to another.

it makes sense, if a car is sold it should be deemed roadworthy by someone certified before it is allowed back on the road.

we have never had to report plates stolen b/c the threat is more than enough motivation for people to do the right thing, however if we ever needed to we would explain the situation fully.

The law in Victoria used to be that when selling a vehicle, it must come with a RWC from the owner to the buyer.

That has now changed. There are special conditions when a vehicle must be sold with a RWC and I think that's mainly from car yards and so on.

To Clarify

it's not 'the law' it's a requirement: a totally different thing

plus the buyer can actually agree to purchase a car without an insp cert and that fact can be recorded on the receipt. The buyer can then get one themselves prior to transfer

a car is not deemed unregoed once sold until the new owner transfers it or recorded as such. rego stays with the car and the new owner is required to transfer it into their name within 2 weeks

I suggest you check and confirm the above with VicRoads, I did

the above is the same for NSW except that up here they say the purchaser SHOULD be provided with an inspection cert, again that is a recommendation only
